Intellectual Property (IP) Practice

Our Intellectual Property (IP) practice provides comprehensive legal advice and representation on all aspects of IP law, including trademarks, patents, copyrights, trade secrets, licensing, and franchising. We assist clients in identifying, protecting, and enforcing their IP rights, while also advising on registration, assignments, and user agreements.

Notable Assignments

  • 2014: Auditing the IP portfolio of Kenya Planters’ Co-operative Union (KPCU) and successfully restoring and renewing their trademarks.
  • 2020: Auditing the IP portfolio of TSS Grainmillers Limited (in receivership), renewing trademarks, and managing transfer and assignment of ownership.
  • Advising and representing a client in the acquisition of trademarks and goodwill of TSS Grain Millers.
  • 2021: Auditing the IP portfolio of a confidential client (in receivership), successfully restoring and renewing lapsed trademarks.
  • 2015: Leading audits and assessments of the goodwill of a regional supermarket chain.

Representative Clients & Briefs

  • Sony Corporation of Japan vs. Sony Holdings Limited (Owner of Westgate Shopping Mall): We successfully represented Sony Holdings Limited in several Trade Mark disputes before the Registrar of Trademarks and at the High Court of Kenya. (Appeal currently ongoing at the Court of Appeal in Nairobi).
  • Scotch Whisky vs. Africa Spirits Limited: We have represented and defended Africa Spirits Limited in a Trademark Dispute currently ongoing at the High Court of Kenya.
  • Africa Spirits Limited: Actively involved in defending the Company and its Directors against the closure of their distillery along Thika Road.
  • Rai Cement Group: Successfully registered several Trademarks and Industrial Designs including Rai Cement Ltd, Elgon Cement, Kiboko Cement, Hoima Sugar, Kinyara Sugar, Tasco Industries, Comply Industries Ltd, Nile Ply Woods (U) Ltd, and Nile Fibre Board Ltd.
  • KAPA Oil Refineries Limited: Currently handling registration of several Industrial Designs and providing ongoing legal advice on Intellectual Property Law.
  • WARDROBE Collections Limited: Currently prosecuting an Appeal at the Court of Appeal against the expungement of “POLO” as a Trademark.
